ACCURACY OF CONTENT

H.A. Humberstones Ltd has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. Some item descriptions may have been taken from our B2B  suppliers for accuracy and best desciption for your concern. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery. To the extend permitted by applicable law, H.A. Humberstones Ltd disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website.

However, we cannot guarantee that your use of this website or any websites accessible through it won't cause damage to your computer. PRICE

All prices are displayed inclusive of VAT unless stated otherwise, and where applicable. For a VAT receipt please e-mail us at enquiries@humberstonesjewellers.co.uk with the subject line of your order number and VAT receipt request please. The prices payable for goods that you order are as set out in our website. 

PAYMENT TERMS

We will charge your credit/debit card upon receipt of your order. We will offer a refund if we are unable to provide your receipt and will be communicated via e-mail with you. We accept no liability if a delivery is delayed because you did not give us the correct payment details.

AVAILABILITY

All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available. You will have the option to wait until the item is available, to choose an alternative or to cancel your oder. We will provide you with a full refund or compensate the difference if required to do so.

ORDERING ERRORS

You are able to correct errors on your order up to the point at which you click on 'pay now' or 'confirm order' on the final page of our ordering process.

DELIVERY CHARGES

For delivery charges please click here: Delivery & Shipping or find at the top of the page, under 'Your Shopping'. All UK orders are free of charge regardless of the size, unless special delivery is identified. Your delivery charges will be clearly indicated at checkout. We are unable to refund postage costs unless an item is broken and is with its original labels and packaging.

DELIVERY

H.A. Humberstones Ltd will deliver goods to the address you specify in your order. It is important that the address is accurate. A signature is required at the delivery address as confirmation and acceptance of delivery. We cannot accept any liability for any loss or damage to the goods once they have been delivered. We aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed. If delivery is delayed due to any cause beyong our reasonable control, the delivery date will be extended by a reasonable period and we will contact you. Your will be notified when we dispatch your item by e-mail.

RISK & OWNERSHIP

Risk of damage to or loss of the goods passed to you at the time of delivery, or if you fail to take the delivery at the agreed time, the time when we tried to deliver. You will only own the goods once they have been successfully delivered and when we have received payment in full for the goods.

ACKONWLEDGEMENT & ACCEPTANCE OF YOUR ORDER

If you have supplied us with your e-mail address we will notify you by e-mail as soon as possible to confirm receipt of your order. Our acceptance of your order will take place upon dispatch of the product(s) ordered. We must receive payment of the whole of the price of the goods that you order before your order can be accepted. Your payment of the price of the goods represents an offer on your part to purchase the goods, which will be accepted by us when we send you an e-mail that the goods have been sent out to you. Our acceptance of your order brings into existence a legally bunding contract between us. 

CANCELLATION RIGHT

Under the distance selling regulations, you have the legal right to cancel your order within 7 working days of receipt of the goods. You don't need to give us a reason for canceling your contract. Where goods are delivered to a third party, you will only be able to exercise this right if you are able to return to us the goods you ordered. If you have received the goods before you cancel your contract with us, you are legally obliged to send them back to our Humberstones Jewellers office at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery, you must not unpack the goods when they are received by you and you must send the goods back to us.  Once you have notified us that you are cancelling your contract, any sum debited to us from your debit/credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order, provided that the goods in question are returned by you and received by us in the same condition they were in when they were delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we will be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

CANCELLATION BY H.A. HUMBERSTONE LTD

We reserve the rights to cancel the contract between us if we have insufficient stock to fulfill the order and any of the goods ordered was listed at an incorrect price due to a typographical error. If we do cancel your contract, we will notify you by e-mail and will re-credit your account as soon as possible.

EXCLUSIONS OF LIABILITY

Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death of personal injury caused by the negligence of H.A. Humberstones Ltd or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and constued in accordance with Law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

This website, any content contained here in and any contract brought into being as a result of usage of this website are governed by and construed in accordance with UK Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of the UK. All contracts are concluded in English.
